Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the fourBallBuddy mobile application, website, and related services (collectively, the "Service"), operated by fourBallBuddy ("we," "us," or "our").

By registering for an account, downloading the app, or using any part of the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use fourBallBuddy. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

You may not use the Service if you have previously been suspended or removed from fourBallBuddy.

3. Your Account

Registration

You must create an account to use most features of fourBallBuddy. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

Account security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@fourballbuddy.com if you suspect unauthorized access to your account.

One account per person

You may only maintain one active account. Creating multiple accounts to circumvent bans, ratings, or other restrictions is prohibited.

4. The fourBallBuddy Platform

What we provide

fourBallBuddy is a marketplace platform that connects golfers who want to fill open spots in their tee times with golfers looking to join rounds. We provide the technology to facilitate these connections — we are not a golf course, a tee time booking service, or a party to any agreement between players.

We are a platform, not a party

fourBallBuddy does not organize, supervise, or control any golf rounds. All arrangements regarding tee times, green fees, payment, and conduct on the course are solely between the participating players. We are not responsible for the actions or omissions of any player, or for any aspect of the golf round itself.

Tee time accuracy

Hosts are responsible for ensuring the accuracy of tee time information they post, including course, date, time, green fee, and available spots. fourBallBuddy is not responsible for inaccurate listings.

5. Hosting a Round

When you post a tee time as a host, you agree to:

• Provide accurate information about the round including course, date, time, available spots, and estimated green fee
• Honor your commitment to players who join your round
• Notify joined players promptly if you need to cancel, using the in-app cancellation feature
• Not cancel a round within 24 hours of the scheduled tee time except in genuine emergencies
• Treat all players with respect regardless of skill level, background, or any other characteristic
• Not list rounds at courses where you do not have a confirmed tee time

6. Joining a Round

When you join a tee time as a player, you agree to:

• Honor your commitment to attend the round
• Notify the host promptly if you are unable to attend
• Provide accurate profile information including handicap index and skill level
• Pay your share of the green fee as agreed with the host
• Arrive on time and maintain the pace of play agreed upon in the listing
• Treat all players with respect on and off the course

7. No-Shows and Cancellations

Repeated no-shows or last-minute cancellations harm the fourBallBuddy community. Players with a pattern of no-show behavior may receive warnings and may have their accounts suspended or terminated at our discretion.

fourBallBuddy does not currently process payments between players. Any disputes about green fees or other payments are between the players involved and must be resolved directly.

8. Reviews and Ratings

After completing a round, players may leave reviews and ratings for their playing partners. You agree that reviews you submit will be:

• Honest and based on your actual experience playing with that person
• Free from personal attacks, harassment, or discriminatory content
• Not submitted in exchange for payment or other incentives

We reserve the right to remove reviews that violate these Terms or our Community Guidelines. Ratings are used to build your player reputation on the platform and may affect your ability to join certain rounds.

9. Community Standards

fourBallBuddy is built on mutual respect between golfers. You agree not to:

• Harass, threaten, or intimidate other players in any way
• Discriminate against players based on race, ethnicity, national origin, religion, gender, sexual orientation, age, disability, or any other protected characteristic
• Post false, misleading, or fraudulent tee time listings
• Use the platform for any commercial purpose without our prior written consent
• Attempt to circumvent our rating or review system
• Share another user's personal information without their consent
• Use the app in any way that violates applicable laws or regulations
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure

10. AI Caddie Feature

The AI Caddie feature is powered by Anthropic's Claude API. When you use AI Caddie, your questions and relevant profile/equipment data are sent to Anthropic's API for processing. AI Caddie responses are for informational and entertainment purposes only and do not constitute professional golf instruction or advice. We are not responsible for the accuracy of AI-generated recommendations.

AI Caddie is available to free users with a daily usage limit. Buddy+ subscribers receive unlimited access. We reserve the right to modify access tiers and limits at any time.

11. Intellectual Property

The fourBallBuddy name, logo, app design, and all related content are owned by or licensed to fourBallBuddy. You may not use our trademarks, logos, or branding without prior written permission.

By submitting content to the platform (reviews, profile information, round data), you grant fourBallBuddy a non-exclusive, worldwide, royalty-free license to use, display, and process that content for the purpose of operating and improving the Service.

12. Disclaimers

fourBallBuddy is not responsible for:

• The conduct of any player on or off the course
• The accuracy of handicap indexes or skill levels reported by players
• Any injuries, property damage, or other harm arising from a golf round arranged through the platform
• Any disputes between players regarding green fees, pace of play, or any other matter
• Course conditions, availability, or any actions of golf course staff

13. Limitation of Liability

To the fullest extent permitted by applicable law, fourBallBuddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of $100 USD or the amount you have paid us in the past 12 months.

14. Indemnification

You agree to defend, indemnify, and hold harmless fourBallBuddy and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your conduct in connection with any golf round arranged through the platform.

15. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us at support@fourballbuddy.com.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Florida.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via in-app notification or email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
